Kausik (Rejected) CRM (NDPS) 1733 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dakhineswar Police Station Case No. 106 of 2025 dated 18.07.2025 under section 8(C)/21(C)/25/29 NDPS Act, 1985. Mr. Avishek Sinha Mr. Saptarshi Chakraborty ……for the State. Learned advocate appearing for the petitioner submits that there were recovery of 101 Kgs. of Ganja which is the subject matter of the case. Three of the petitioners are ladies, while rest of the petitioners were waiting near the metro station. Learned advocate has also questioned the memo of arrest as well as by comparing the timings mentioned therein with that of the formal FIR which has been registered for investigation. It has also been pointed out that the videography which has been done reflects from the forwarding report that relevant part has only been videographed. 2 Learned advocate for the State opposes the prayer for bail and submits that huge quantity of contraband has been seized. I have taken into account the subject matter of the case and is of the opinion that the rigors of Section 37 is attracted. There are issues which have been canvassed by the learned advocate for the petitioner but the same are questions of facts to be decided at the time of trial. Petitioners are in custody for six and a half months. Since custodial trial would be in progress, learned Trial Court would see for the time being that the witness action commences immediately after the stage of consideration of charges. Petitioner would approach this Court at the appropriate stage. Accordingly, CRM (NDPS) 1733 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
