ORAL ORDER
This petition is filed under Section 482 of Cr.P.C seeking to quash the proceedings in C.C.No.54778/2018 arising out of Crime No.452/2016 pending on the file of X ACMM, Mayo hall, Bengaluru now before the XXIX ACJ, Mayo hall, Bengaluru, against the petitioners for the offence punishable under Sections 498A, 506 r/w 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for short, 'DP Act').
2. The brief facts of the case are that the marriage of respondent No.1 with petitioner No.1 was solemnized on
26.06.2012. Thereafter, they lived together cordially for some time. Subsequently, petitioner No.1-accused No.1 allegedly subjected respondent No.1 to harassment and cruelty, demanding additional dowry. Consequently, respondent No.1 lodged a private complaint in PCR No.52764/2016 before the learned X ACMM, Mayo Hall, Bengaluru, against the petitioners and another.

3. The learned Magistrate referred the private complaint under Section 156(3) of the Cr.P.C. to the jurisdictional police, namely, K.R. Puram Police, for investigation. Pursuant thereto, the police registered a case in Crime No.452/2016 dated 19.08.2016 against the petitioners and another for the offences punishable under Section 498A of IPC and Sections 3 and 4 of DP Act. Upon completion of the investigation, respondent No.2-Police filed the charge sheet against the petitioners and another for the offences punishable under Sections 498A, 504 and 506 r/w Section 34 of IPC and Sections 3 and 4 of DP Act. However, the learned Magistrate took cognizance of the aforesaid offences, except the offence punishable under Section 504 of IPC, against the petitioners and another.
4. Subsequently, accused No.2 died, and the said fact was reported before the jurisdictional Magistrate on
02.03.2021. Consequently, the proceedings against accused No.2 stood abated.
5. Heard the learned counsel for the respective parties.

Learned counsel for the petitioners submits that the petitioners and respondent No.1 have entered into a compromise and amicably settled their dispute. It is further submitted that petitioner No.1 and respondent No.1 had filed a divorce petition in M.C. No.8/2016, which came to be allowed by the jurisdictional Court, and a decree of divorce was granted vide judgment dated 23.10.2018. The said position is not disputed by learned counsel for respondent No.1, who fairly submits that, in view of the settlement arrived at between the parties, the proceedings against the petitioners may be quashed.

Having regard to the submissions made by learned counsel for the parties and considering that the parties have amicably settled their dispute and respondent No.1 has consented to quashing of the proceedings against the petitioners, the present petition deserves to be allowed. Accordingly, the proceedings against petitioner Nos.1 and 3/accused Nos.1 and 3 in C.C. No.54778/2018, arising out of Crime No.452/2016 registered by K.R. Puram Police Station for the offences punishable under Sections 498A, 506 r/w Section

34 of IPC and Sections 3 and 4 of the DP Act, pending on the file of the learned XXIX ACMM, Mayo Hall, Bengaluru, are hereby quashed.
