The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 126/109/118/3(5) of the BNS, 2023 in connection with Gamharia PS Case No. 117 of 2025. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that the main allegation is against the accused, namely, Rishu Thakur who had made fire. It has been submitted that in this case charge- sheet has been submitted and the petitioner is in custody since 26.11.2025 as such, the petitioner may be enlarged on bail. 4. Learned APP opposes the prayer for bail of the petitioner. 5. Having regard to the allegation made against the petitioner coupled with the fact that the main allegation is against co-accused and the petitioner is in custody since 26.11.2025, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the 2026:JHHC:5632 2 satisfaction of learned Chief Judicial Magistrate at Saraikella in connection with Gamharia PS Case No. 117 of 2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner. 7.
