JUSTICE B.PRAMOD ORAL ORDER 1. The petitioners in the present writ petition are seeking the following reliefs: "i) Issue a writ in the nature of mandamus and direct the Respondents to permit the Petitioners to conduct a common/joint (Samuhika) Ganapati Visarjana procession through Ambedkar Colony Road, Mysore Road, beginning from T.B. Circle through Mysore- Jevargi National Highway 150A, SBI Circle, Mariyappa Circle, Mandya Circle, Mysore Road near A.D. Colony and Ambedkar Colony, u-turn to Mariyappa Circle, K.S.T. Circle, Sri Keshavaswami Temple gate, T.A.P.M.S. Road to circle, Marigudi Circle in Puduvalapattana Road, Badagudumma Circle, and through Old Post Office Road to Hampe Arasana Kole, by considering their representation dated 23-08-2025, 29-08-2025, and 01-09-2025 (produced at Annexure-A to A4). ii) Issue any other writ or order and grant such other and further reliefs as this Hon'ble Court may deem fit in the facts and circumstances of the case." 2. Heard Sri. Suyog Herele E, learned counsel appearing for the petitioners, and Sri. M Srinivas Kumar, learned HCGP, appearing on behalf of the respondents. - 4 - HC-KAR CNR: KAHC010586782025 NC: 2026:KHC:49860 WP No. 26792 of 2025 3. The relevant brief facts of the case are that Petitioner No. 1 is an unregistered organization formed by like-minded people of Nagamangala with the object of organizing a Ganesh Visarjana program in the Taluk. Petitioner No. 2 herein are the members of "Bheemaena Yuvaka Balaga" and residents of Ambedkar Colony, who have been organizing and celebrating Ganesha Chathurthi in the Nelamangala Town. 4. On 03.09.2025, a Co-ordinate Bench of this Court noted the following contentions of the petitioners, which read as under: "....As such, the petitioners' request for an interim order to take the procession through the route (i.e., as mentioned in the interim prayer column) is not considered for the present occasion. However, the jurisdictional police is directed to take all measures (prior to and during the procession, as permitted) to ensure that there are no untoward incidents and that there are no lapses." - 5 - HC-KAR CNR: KAHC010586782025 NC: 2026:KHC:49860 WP No. 26792 of 2025 5. Now, learned counsel appearing for petitioners does not dispute that the issue in hand is academic. Hence, the writ of mandamus as sought will not arise at this juncture, but that will not preclude the petitioners from making an application to the respondents seeking permission for the procession for Ganapathi Visarjana for the present year. 6. In view of above, petitioners are at liberty to make the necessary application or a representation in accordance with law to the respondents. In view of the earlier observation made by the Co-ordinate Bench supra, the respondents, particularly the third respondent — the jurisdictional police — are directed to ensure compliance with the measures as indicated above. 7. If the petitioners make any representation or application, the third respondent/respondents are directed to consider the same strictly in accordance with law and communicate the decision to the petitioners forthwith. - 6 - HC-KAR CNR: KAHC010586782025 NC: 2026:KHC:49860 WP No. 26792 of 2025 8. It is needless to mention that disposal of this present writ petition will not affect the consideration of the representation of the petitioners in contemplation by the respondents. 9.
