Heard Mr. R. Sarmah, learned counsel for the petitioner; Mr. N. Upadhyay, learned Standing Counsel, Irrigation Department for the respondent nos. 1, 3, 4 & 5; and Ms. R.M. Baruah,
learned counsel on behalf of Mr. A. Chaliha, learned Standing Counsel, Finance Department for the respondent no. 2.
2. The petitioner had earlier approached this Court by a writ petition, W.P.[C] no. 4749/2025 aggrieved by non-payment of outstanding bill amount of Rs. 4,31,909/-, which amount he had claimed for execution of a contract-work on behalf of the Irrigation Department, Government of Assam.
3. When the said writ petition came up for consideration on 01.09.2025, the Court after hearing the learned counsel for the parties and considering the nature of dispute, disposed of the writ petition granting liberty to the petitioner to approach the competent authority in the Irrigation Department by filing a representation for redressal of his grievances within a period of fifteen days. It was observed that after filing of such representation within the stipulated time period, the respondent authorities in the Irrigation Department, Government of Assam shall consider and dispose of the same in accordance with law. Subsequent to the Order dated 01.09.2025, the petitioner had submitted a Representation before the respondent no. 4 on 11.09.2025 and the office of the respondent no. 4 had duly acknowledged the receipt of the same.

4. Aggrieved by non-disposal of the Representation, the petitioner has approached this Court again by the instant writ petition.
5. Mr. Sarmah, learned counsel for the petitioner has submitted that as in the Order dated 01.09.2025, no time limit has been mentioned for disposal of the Representation, the respondent authorities might perhaps be sitting over the matter.
6. Mr. Upadhyay, learned Standing Counsel, Irrigation Department has submitted that if the Representation dated 11.09.2025 has not yet been disposed of till date, then the respondent authorities in the Irrigation Department be granted 2 [two] months’ time to dispose of the Representation, stated to have been submitted by the petitioner on 11.09.2025, by way of a speaking order.
7. Mr. Sarmah, learned counsel for the petitioner has agreed to the above submission made by Mr. Upadhyay, learned Standing Counsel, Irrigation Department, Government of Assam.
8. Having regard to the nature of dispute and the broad consensus arrived at by the
learned counsel for the parties in the afore-stated manner, this writ petition is disposed of with a direction to the respondent authorities in the Irrigation Department, Government of Assam, more particularly, the respondent no. 3 to take the Representation of the petitioner, stated to have been submitted on 11.09.2025, on board and thereafter, to dispose of the same by way of a speaking order within a period of 2 [two] months from the date of submission of a certified copy of this order along with a copy of the writ petition with annexure at his office by the petitioner.
