2 of the respondent 2 to 4 in not pronouncing the final results of the candidates of SPSR Nellore District, who appeared for certificate verification for the notification no.01/2019 dated 26.07.2019 and subsequently issuing the notification no.01/2020 dated 10.01.2020 as arbitrary, illegal and violation of Fundamental rights guaranteed under Art.14 and Art. 16 of Constitution of India and consequent direct the respondents 2 to 4 to reserve one of the post to the petitioner.

ORDER:-
The Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"…..to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 4 in not pronouncing the final results of the candidates of SPSR Nellore District, who appeared for certificate verification for the notification no.01/2019 dated 26.07.2019 and subsequently issuing the notification no.01/2020 dated 10.01.2020 as arbitrary, illegal and violation of Fundamental rights guaranteed under Art.14 and Art.16 of Constitution of India and consequently direct the respondents 2 to 4 to reserve one of the post to the petitioner and pass such other orders……."
2. The respondents herein have issued notification No.01/2019 dated 26.07.2019 inviting applications for the post of Village Agriculture Assistant (Grade-II) for total posts of 537 and 107 posts. The petitioner herein has applied for the said post and the respondents have issued call letter to attend for interview. Accordingly, the petitioner has attended for certificate verification on 12.02.2020. However, the case of the petitioner was not considered on the ground
4 that the petitioner has not possessed requisite qualification and the petitioner possessed B.Sc. (Bio-Technology).

It is the contention of the writ petitioner that with regard to the same notification No.01/2019, some of the aspirants, who are on the same footing with the petitioner, approached this Court by way of filing Writ Petition No.18108 of 2019 and this Court disposed of the said Writ Petition directing the petitioners therein to file a representation to the authorities and the same may be considered in accordance with law. Albeit, the petitioner is not party to the Writ Petition No.18108 of 2019, the respondents have considered and issued temporary appointment
order to the petitioner herein, vide Procdgs.No.Estt.IV/1018/2018 dated 08.12.2022.
4. Now the learned counsel for the petitioner would request this Court to direct the respondents to confirm the appointment that was issued on 08.12.2022 vide Procdgs.No.Estt.IV/1018/2018.
5. As seen from the above said appointment order, it is not a temporary appointment and it appears to be a permanent appointment. In view of the same, the respondents herein are directed to appoint the petitioner on permanent basis after completion of probation.

6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel thereto, interlocutory applications pending if any, shall stand closed.
