ORAL ORDER The petitioner is before this Court seeking the following prayer:
"WHEREFORE, the Petitioner most humbly prays that this Hon'ble Court may be pleased to quash the complaint, prevention action report, proceedings and impugned
order dated 19.11.2025 in SANKYA/C.R.M./M.A.G./21/2025/DCP(U)/BE.NAAG AR (PAR NO.48/2025 of Peenya Police Station) for the offense punishable under Section 129(g) of the Bharatiya Nagarika Suraksha Sanhita, 2023, passed by the Court of the Special Executive Magistrate and Deputy Commissioner of Police, North West Division, at Bengaluru City and consequently, direct the petitioner be released, in the interest of justice and equity."
2. This Court on 30.01.2026 had passed the following
order:
"This Court on 23.01.2026, had passed the following order:

“Learned counsel for petitioner submits that the petitioner is not able to execute a bond as the petitioner is in custody. Learned Additional State Public Prosecutor submits that there are plethora of crimes pending against this petitioner. One such crimes, is for the offence under Section 135 of the BNSS or Section 107 of the Cr.P.C. - the earlier regime.
Learned counsel for the petitioner submits that if a direction is given, the petitioner would execute a bond from the custody itself. In that light, the Prison Authorities shall make such arrangements for execution of a bond in terms of the law. The bond shall be executed by the petitioner in accordance with law, with the help of the sureties or otherwise. List this matter on 13.02.2026.”
Learned counsel for the petitioner submits that despite the order, the petitioner is not been released from prison on the twin score, one, that he has not executed the bond and there is no
order directing him to be released. In that light, in the event, the bond is executed in accordance with law, the petitioner shall be released forthwith. Hand delivery of the order is permitted"
3. The petitioner is said to be set at liberty today on acceptance of the order passed by this Court.

4. In that light nothing survives for further
consideration in the case, the petition is disposed of as having become infructuous.
