In this writ petition, petitioner is assailing the order dated 29.04.2016 (Annexure - B) passed by the respondent No.2 and the order dated 30.11.2018 (Annexure - D) passed by the respondent No.1. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned - 4 - HC-KAR CNR: KAHC010221142023 NC: 2026:KHC:49043 WP No. 10325 of 2023 orders would indicate that, the petitioner is claiming right over the property based on the registered sale deed dated 02.04.2002. 4. In that view of the matter, as respondent Nos.4 to 6 have filed a suit in O.S. No.25/2009 before the competent Civil Court, I am of the view that respondent Nos.1 and 2 have committed an error in entering the names of the private respondents in the mutation register, without taking into consideration the fact that the petitioner claims right over the subject property on the basis of a registered instrument. In that view of the matter, I pass the following: ORDER. i) The writ petition is allowed. ii) The order dated 29.04.2016 (Annexure B) passed by the respondent No.2 and the order dated 30.11.2018 (Annexure - D) passed by the respondent No.1, are accordingly set aside. - 5 - HC-KAR CNR: KAHC010221142023 NC: 2026:KHC:49043 WP No. 10325 of 2023 iii) The respondent No.3 is directed to enter the name of the petitioner in the mutation entry based on the registered sale deed dated 02.04.2002 within a period of two months from the date of certified copy of this order.
