JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed seeking to quash the complaint registered in Crime No.54/2026 before the Mangalore East Police Station for the offences punishable under Sections 140(2), 308(2), 115(2), 126(2), 352 and 351(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. The Co-ordinate Bench of this Court, on 06.08.2026, directed the respondent-State to produce the antecedents, if any, of the petitioners. Thereafter, the petitioners and respondent No.2 filed an application seeking to compound the offences and quash the proceedings. 3. Learned Additional Special Public Prosecutor has filed a memo disclosing the antecedents against all the petitioners. It is noticed that there are around 19 cases pending against petitioner No.2 and 5 cases against petitioner No.1 and 2 cases against petitioner No.3. Out of the 19 cases against petitioner No.2, 15 cases have ended in acquittal and 2 cases are pending. As 5 cases against petitioner No.1, 3 cases have ended in acquittal and 1 case is pending. As against petitioner No.3, 1 case has been quashed and 1 case is pending. 5. Considering the history of the petitioners, the Court is of the view that this is not a fit case to quash the investigation by accepting the application to compound the offences and to quash the proceedings. 6. Hence, the petition is dismissed. 7. It is made clear that this Court has not expressed anything on the merits of the complaint.
