This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the applicant who is apprehending his arrest in connection with Crime No. 194 of 2026 registered at Police Station Khairagarh, District – Khairagarh- Chhuikhadan-Gandai (C.G.) under Sections 34 (1) (a), 34 (2), 36, 49-A (b) (c), 59 (A) (i) (ii) of the BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 Chhattisgarh Excise Act, Section 61 (2), 318 (4), 336 (2), 336 (3), 340 (2) and 338 of BNS. 2. Learned State counsel raised an objection with regard to maintainability of this bail application on the ground that applicant was earlier arrested and thereafter produced before the Court of ACJM, Alipore (W.B). The Court at Alipore has released the applicant on interim bail with a direction to applicant to appear before the Court of Chief Judicial Magistrate, Khairagarh on or before 15.06.2026 and to submit compliance report. It also appears that applicant failed to comply with the direction issue by ACJM, Alipore and this application is filed against issuance of arrest warrant. The applicant is having remedy to file appropriate application for cancellation of arrest warrant. 3. At this stage, learned counsel for applicant submits that in view of the objection raised by learned State counsel, he will file appropriate application seeking cancellation of arrest warrant. 4. In view of the above submission made by learned counsel for parties, this application for grant of anticipatory bail is disposed of with liberty to applicant to file appropriate application seeking cancellation of bail, before the concerned Court.
