ORAL ORDER
Petitioner, who is apprehending arrest in Crime No.103/2025 registered by C.C.B. Bengaluru City Police, Bengaluru for the offences punishable under Sections 120(B), 406, 419, 420, 465, 468, 471, 504 and 506 read with Section 34 of IPC, is before this Court in this petition filed under Section 482 of BNSS 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.103/2025 was registered by C.C.B. Bengaluru City Police, Bengaluru for the aforesaid offences against Shamshad Begum and others, based on the first information dated 23.12.2025 received from Sri.

Sangamesh Rachaiah Vastrada. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.6638/2026 before the jurisdictional Sessions Court, which was rejected on 15.07.2026. Therefore, he is before this Court.
4. Material on record would go to show that the petitioner's name is not found in the FIR. It appears that, during the course of investigation, an enquiry notice dated 19.06.2026 under Section 35(3) of BNSS, 2023 was issued to the petitioner. Apprehending arrest, the petitioner had therefore approached the jurisdictional Sessions Court.

Learned counsel for the petitioner submits that the petitioner himself is a victim of the alleged fraud and he had protested in front of the house of the accused persons after the FIR was registered. The Police had initially refused to receive a complaint from the petitioner for the reason that an FIR had already been registered with similar allegations. Be that as it may, the fact remains that the petitioner has no other criminal

antecedents and is aged about 26 years. He has undertaken to cooperate with the police for the purpose of investigation.
6. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following :
O R D E R
i) The criminal petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.103/2025 registered by C.C.B. Bengaluru City Police, Bengaluru for the offences punishable under Section 120(B), 406, 419, 420, 465, 468, 471, 504 and 506 read with Section 34 of the IPC, subject to the following conditions:

a) The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer.
b) The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
c) The petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
d) The petitioner shall not involve in similar offences in future.
