1. The petitioner, sons of one late M.P.Suranna are before this Court with a grievance that an application dated 23.03.1991 filed by their father Sri.M.P.Suranna seeking re-grant of land in Survey No.8 measuring 3 acres 19 guntas and Survey No.18 measuring 1 acre 7 guntas of Lingadahalli Village and Survey No.54 measuring 5 acre 12 guntas of Gidaganahalli Village, on the premise of same being Shanbhog Inamthi land has not been considered by the respondent - authority till date.

Learned counsel for the petitioners submits after demise of said Sri.M.P.Suranna, the petitioners had followed up the matter making repeated representations, yet the same has fallen on deaf ear. He further refers to a specific direction stated to have been issued by the State Government vide communication to the Deputy Commissioner on 05.07.2025 as per Annexure-Q to take necessary action and to submit the report of various

Yet the Deputy Commissioner has not taken any action in the matter. Hence, the present writ petition is filed seeking direction for expeditious disposal of the application.
3. Learned Additional Government Advocate submits that, given some time, the matter will be looked into and appropriate order in this regard will be passed.

Perusal of the record would indicate that father of the petitioners claiming to be the holders of the office of Shanbhog Office to which the aforesaid lands were attached, had made an application as per Annexure-A as far back as on 23.03.1991. There is no justifiable reason by the respondent - authority not to consider the said application or pass the order one way or the other, in accordance with law. There also appears to be a communication issued by the respondent-State as per Annexure-Q to consider the matters listed therein

HC-KAR CNR: KAHC010571042026 NC: 2026:KHC:47654 WP No. 25977 of 2026 including the matters pertaining to the petitioners and to submit a action taken report. Yet, no action seem to have been taken. Therefore, in the circumstances, the petition deserves to be allowed. Hence, the following;
ORDER (i) The writ petition is allowed. (ii) Respondent No.4- Tahsildar, who is now vested with the power under the Karnataka Village Officers Abolition Act, 1961 to consider the application at Annexure-A and after affording opportunity to the petitioners, pass appropriate
order, one way or the other, in accordance with law, within an outer limit of six months from the date of receipt of certified copy of the order. (iii) He shall also ensure, if there are any rival claims, he shall give opportunity to them as well. (iv) It is made clear that, no opinion is expressed in this order regarding the merits or otherwise the claim made by the petitioners.
