The petitioner has renewed his prayer for bail in connection with Burmamines (Jamshedpur) P.S. Case No.93 of 2022 (G.R. No.458 of 2023 and S.T. No.302 of 2023) for the offence registered under Sections 307, 326, 120(B) and 34 of the IPC, 1860 and Section 27 of the Arms Act. Earlier prayer for bail of the petitioner was rejected on merits. Prayer for bail has been renewed on the ground that the case was posted for final argument, but trial could not be concluded because one of the co-accused who was on bail, absconded and the case has now been posted for his appearance. In view of the fact that case is now at the final stage and there is flight risk, as one of the co-accused has already absconded, therefore, the prayer for bail of the petitioner is again rejected. However, the learned Trial Court is directed to proceed and conclude the trial as per the law considering the provisions enshrined under Section 356 of the BNSS, 2023. Further, S.S.P., Jamshedur, East Singhbhum is directed to take appropriate steps for execution of the processes issued against the absconding accused in this case.
