Mr. Suhail A. Siddiqui, learned counsel for applicant. 2. Mr. S. C. Dumka, learned A.G.A. for the State of Uttarakhand/respondent. 3. Applicant is before this Court seeking anticipatory bail in connection with FIR No.32 of 2017 dated 10.03.2017 registered with P.S. Pant Nagar, District Udham Singh Nagar for the offences punishable under Sections 420, 465, 466, 468, 471, 474, 511, 120-B and 34 IPC (S.S.T. No.2 of 2020 State Vs. Pankaj Sharma & others), pending in the court of learned Special Judge (Anti Corruption), Nainital. 4. It is contention of learned counsel for the applicant that the said FIR was lodged against as many as 113 accused persons, in respect of same land scam, which is commonly known as ‘N.H. Ghotala in Uttarakhand’. It is further submitted by him that most of the accused persons have been enlarged on bail by this Court, and many of them have been given anticipatory bail by this Court. He further submitted that this is a case of parity. 5. It is also submitted by learned counsel for applicant that the applicant has no previous criminal history. 6. 2026:UHC:1949 not dispute this fact of the case being of parity with those who have already been released on bail or anticipatory bail. However, learned State Counsel submits that non- bailable warrant has already been issued against applicant. 7. Similar order passed by this Court is also annexed by the applicant in the present Anticipatory Bail Application. 8. In view of the above, this Court is inclined to grant the anticipatory bail to the applicant. 9. Accordingly, the anticipatory bail application is allowed. 10. In the event of applicant being arrested, the applicant shall immediately be released on anticipatory bail by the Investigating Officer on furnishing the personal bond and two reliable sureties each in the like amount to the satisfaction of the Court concerned, on the following conditions:- (i).Applicant shall attend the court proceedings regularly and will not seek any unnecessary adjournment; (ii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case.
(iii)Applicant shall not leave the country without the previous permission of this Court. 11. Pending application, if any, stands disposed of. (Pankaj Purohit, J.)
