JUSTICE BIPIN GUPTA Judgment / Order 09/03/2026 1. Without pressing the writ petition on merits, learned counsel for the petitioner submits that his application under Order VII Rule 14(3) CPC has been rejected by the learned Commercial Court. However, he further submits that a provision for taking documents on record in commercial matters has been made available under Order XI Rule 1 CPC, as amended by the Commercial Courts Act. Therefore, he makes an innocuous prayer to file an application under Order XI Rule 1 CPC before the Commercial Court. [2026:RJ-JP:9901] (2 of 2) [CW-4098/2026] 2. Heard. 3. In view of the above, the writ petition is dismissed as withdrawn, and the petitioner shall be at liberty to file an appropriate application under Order XI Rule 1 CPC, as amended by the Commercial Courts Act, for taking the documents on record. 4. It is expected that if any such application is filed, the learned Commercial Court shall decide the same in accordance with law, without being influenced by the order dated 08.12.2025. 5.
