JUSTICE A. GUNESHWAR SHARMA ORDER 22.05.2026 [1] Present Mr. K. Roshan, learned counsel along with Mr. Jonty Roscoe, learned counsel for the petitioner and Mr. S. Kaminikumar, learned CGC for the respondents along with Mr. Jothimalar, Deputy Commandant, CRPF. [2] When the matter was taken up on 15.05.2026, the learned counsel for the petitioner prayed for 1(one) week time for taking instructions as to whether the petitioner is applying for Voluntary Retirement from Service (VRS) and the order dated 15.05.2026 is reproduced below: “15.05.2026 [1] Present Mr. K. Roshan, learned counsel for the petitioner and Mr. S. Kaminikumar, learned CGC along with Mr. Jothimalar, Deputy Commandant, CRPF. [2] By the present petition, the petitioner challenges the transfer order dated 22.12.2025 transferring from GC- Imphal to Recruitment Training Centre (RTC-NMH). It is the case of the petitioner that he is entitled for 1(one) year retention in Oinam Thoib a Meitei Digitally signed by Oinam Thoiba Meitei Date: 2026.05.22 17:47:24 +05'30' terms of the standing order-04/2022 dated 27.09.2022 and he has already submitted representation that his medical category is P3(P) and he is unfit for active service. In the said representation, the petitioner also expressed his desire for Voluntary Retirement Scheme (VRS) in the year, 2027. In the circumstance, 1(one) week time is granted to the petitioner to verify whether he is applying for VRS to the authority or not. [3] List these cases on 22.05.2026. [4] Till the next date, no adverse action be taken against the petitioner without the leave of this Court.” [3] When the matter is taken up today, Mr. K. Roshan, learned counsel for the petitioner, on instructions submits that the petitioner expresses his desire to submit application for VRS to the authority and he may be permitted 2(two) week’s time for applying the same and till then, the petitioner may be retained with the present posting at GC-Imphal. [4] Mr. S. Kaminikumar, learned CGC submits that if the VRS application is not submitted within 2(two) week’s from today i.e. 22.05.2026, the petitioner will not be retained at GC- Imphal and has to proceed with the new posting. [5] Recording the submissions made at the bar, on instructions from the parties, the writ petition is disposed of with the following conditions: (i) Petitioner is permitted 2(two) week’s time to file an appropriate application for VRS to the authority, (ii) the date of the application will be treated as the date from which the petitioner wants to retire under VRS, (iii) the respondents shall consider the application of the petitioner as per applicable rule and pass an appropriate order, (iv) till appropriate order is passed by the respondent, the petitioner will be retained at the present posting at GC-Imphal and (v) on failure of the submission of the application for VRS within 2(two) week’s, the petitioner has to proceed to the new posting. [6] With these observations, WP(C) No. 343 of 2026 is disposed of. [7] MC(WP(C)) No. 366 of 2026 is also disposed of, accordingly. JUDGE Thoiba
