ORAL ORDER
Challenging registration of FIR in Crime no.58/2022 by Basavanagudi Women Police Station for offences punishable under Sections 498A, 323, 504, 506 of Indian Penal Code, 1860 (IPC) read with Sections 3 and 4 of Dowry Prohibition Act, 1961 (DP Act) presently stated to be pending on file of XXXVII ACMM, Bengaluru, this petition is filed. 2. Sri A.S.Kulkarni, learned counsel for petitioners submits that petitioners were accused no.2 and 3 in impugned complaint. It was submitted that during pendency of above petition, there was settlement between petitioners and respondent no.2-complainant. 3. A joint memo containing terms of settlement is filed and signed by parties. An application is also filed for compounding of offences. Terms of settlement in joint memo reads as under-
"Petitioners-accused nos.2 and 3 and respondent no.2-complainant do hereby state as follows-
1. We submit that, the petitioners are Accused Nos.2 and 3 respectively in Basavanagudi Women Police Station Crime No.58/2022 (C.C No.17399/2026) for the alleged offence punishable under Section 498-A, 323,

504, 506 of Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act, on the file of the learned 37th Addl. Chief Metropolitan Magistrate, Bangalore. 2. We submit that, the petitioners have filed this petition to quash the FIR in Basavanagudi Women Police Station Crime No.58/2022 for the alleged offence punishable under Section 498-A, 323, 504, 506 of Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act, on the file of the learned 37th Addl. Chief Metropolitan Magistrate, Bangalore. 3. We submit that, at the instance of elders and well-wishers the petitioners, accused No.1 and Respondent No.2 settled their disputes amicably and agreed to dissolve their marriage by decree of divorce. The petitioners and the respondent No.2 have amicably settled all their differences, litigations and claims against each other. 4. We submit that, the matter is purely private, personal and matrimonial in nature. In order to facilitate the petitioners and the respondent No.2 to live happily and move on in the life, it is just and necessary to quash the charge sheet against the petitioner. 5.
We submit that, the matter is settled between the parties and the proceedings against the accused No.1 been quashed by order dated 29.08.2026 in Criminal Petition No.13166/2026. The accused No.1 husband of the respondent No.2 has paid a sum of Rs.15 Lakhs to the respondent No.2 by way of final settlement of the dispute. 6. We submit that, the respondent No.2 out of her own free will, without any force or duress has no objection to quash the F.I.R against the petitioners in this case. Wherefore, we, the petitioners and respondent No.2 most respectfully pray that, this Hon'ble Court may be pleased to permit the petitioners and respondent No.2 to compound the offence and quash the F.I.R against the petitioners - accused Nos.2 and 3 in Basavanagudi Women Police Station Crime No.58/2022 for the alleged offence punishable under Section 498-A, 323, 504, 506 of Indian Penal Code and Section 3 and 4 of the Dowry

Prohibition Act, on the file of the learned 37th Addl. Chief Metropolitan Magistrate, Bangalore, in the interest of justice equity. We do hereby declare that what is stated in this Joint Memo is true and correct to the best of our knowledge, belief and information and to that effect we have signed this Joint Memo."
4. Sri Vivek J.C., learned counsel for respondent no.2- complainant would concur. 5.
Learned counsel for petitioners as well as respondent no.2 submit that parties are present and have identified them.
6. On interaction, complainant submits that she has agreed for settlement out of her free will and volition without there being any threat, coercion or undue influence from anyone and consents for allowing of quashing petition.
7. Smt.Sowmya R., learned HCGP for respondent- State though submits that offences under Sections 498A, 323, 504 and 506 of IPC read with Sections 3 and 4 of D.P. Act are non-compoundable, taking note of settlement, appropriate orders may be passed.

8. Heard learned counsel and perused material on record.
9. This petition is filed for quashing of registration of FIR. A perusal of complaint averments would indicate that dispute arises out of matrimonial discord between complainant and her husband-accused no.2. Since it is stated that dispute between complainant and her husband has been settled in proceedings before Family Court, and as complainant does not wish to pursue proceedings against petitioners herein and concedes for quashing of same, continuation of proceedings would be futile. Therefore, in order to secure ends of justice, especially in light of settlement, it is found appropriate to grant permission for compounding of offences punishable under Sections 498A, 323, 504, 506 of IPC read with Sections 3 and 4 of DP Act.
10. Joint Memo is taken on record. I.A.no.1/2026 filed for compounding is allowed.
11. Petition is allowed, proceedings in Crime no.58/2022 registered by Basavanagudi Women Police Station
