JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 4 are before this Court calling in question proceedings in C.C.No.60634/2026, pending before the XI Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences punishable under Sections 498a, 504 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court in the subject petition by filing a joint memo seeking permission to compound the offences. - 4 - HC-KAR CNR: KAHC010602852026 NC: 2026:KHC:49167 CRL.P No. 13552 of 2026 3. The joint memo reads as follows: "JOINT MEMO 1. That the Petitioner No.1 and Respondent No.2 have amicably settled the dispute between themselves and entered into a memorandum of settlement dated 01.08.2026, before the Karnataka Mediation Centre, Bengaluru and I Additional Family Judge, Family Court, Bengaluru. A certified copy of the Memorandum of settlement dated 01.08.2026 entered between the parties is herewith produced for the kind perusal of this Hon'ble Court. 2. That in furtherance of the above settlement, marriage solemnized with the Petitioner No.1 and Respondent No.2 was dissolved by granting decree of divorce by mutual consent in M.C.No.4622/2026. A certified copy of the Decree of Divorce dated 10.08.2026 is herewith produced for the kind perusal of this Hon'ble Court. (Annexure - J). 3. That in view of the settlement arrived between the parties, both the parties hereby unconditionally withdraw the allegations made against each other. 4. That both parties hereby undertake that they will not make any allegation in future against each other and further undertake that they will not interfere with each other's life in future. 5. That in view of the settlement arrived between the parties, the Respondent No.2 hereby voluntarily, without any force or coercion. withdraw the complaint lodged by her against the Petitioners herein in Crime No.86/2025 before the Respondent No.1 Police. Further she has no objection to quash the entire proceedings pending in C.C.No.60634/2026, pending on the file of XI Additional Chief Judicial Magistrate Court, Mayohall Unit, Bengaluru, Bengaluru. Hence this Joint Memo.” - 5 - HC-KAR CNR: KAHC010602852026 NC: 2026:KHC:49167 CRL.P No. 13552 of 2026 Since it is a dispute between the couple and their family members and that the allegations are not against the State, I deem it appropriate to accept the joint memo and terminate the proceedings against the petitioners. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.60634/2026, pending before the XI Additional Chief Judicial Magistrate, Mayohall, Bengaluru, stands quashed. I.A.No.1/2026 is also disposed, as a consequence.
