JUSTICE SHIVASHANKAR AMARANNAVAR) This petition is filed by accused No.1 under Section 439 of Cr.P.C read with Section 483 of BNSS praying to grant bail in S.C.No.296/2019 (Crime No.182/2018 of Kodigehalli Police Station) registered for offences punishable under Sections 397, 302 read with Section 34 IPC pending on the file of LXII Additional City Civil and Sessions Judge, Bangalore City. 2. Heard learned counsel for the petitioner and learned Additional SPP for the respondent –State. 3. The petitioner –accused No.1 earlier has been granted bail in Criminal Petition No.2228/2019 by the order dated 30.07.2019. Thereafter, he appeared in the Sessions Court in S.C.No.296/2019 and remained absent on 05.03.2024. NBW has been issued against him and he has been secured by executing NBW on 16.09.2015 and since then he is in judicial custody. 4. The petitioner has deposited Rs.1,00,000/- towards forfeited bond amount on 22.04.2026 in - 3 - HC-KAR NC: 2026:KHC:22940 CRL.P No. 14730 of 2025 S.C.No.296/2019 and receipt has been produced in that regard. The said amount requires to be appropriated to the State towards forfeited bond amount. It is submitted that the petitioner had another case in Crime No.46/2018 and therefore, he could not appear in the present case and also that he has lost communication with the counsel. The petitioner has now undertaken to appear before the trial Court on all dates of hearing. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. 5. In the result, the following ORDER i) The petition is allowed. ii) The petitioner –accused No.1 is granted bail in S.C.No.296/2019 (Crime No.182/2018 of Kodigehalli Police Station) registered for offences punishable under Sections 397, 302 read with Section 34 IPC pending on the file of LXII Additional City Civil and Sessions Judge, Bangalore City subject to following conditions: - 4 - HC-KAR NC: 2026:KHC:22940 CRL.P No. 14730 of 2025 a) The petitioner –accused No.1 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the trial Court. b) The petitioner –accused No.1 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.1 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
