Affidavit of service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition petitioner prays for direction upon the concerned police authorities to take steps which will preserve his right over the land in question. 3. State respondents are represented by learned advocate. 4. However, on perusal of order dated 17th February, 2014 passed by a coordinate bench on the writ petition being WPA 4220 of 2014 (Siddheswar Das & Ors. Vs. The State of West Bengal & Ors.) it appears that a suit was filed by the petitioners in that writ petition where present petitioner is defendant and an order was passed on 21st November, 2013 directing 2 the parties to maintain status quo. It is submitted on behalf of petitioner today that said ad interim order of injunction still subsists and suit is pending for adjudication before the Civil Court. 5. Since there is no alteration of position with regard to right of respective parties over the land in question due to pendency of suit instituted by the petitioners in writ petition being WPA 4220 of 2014, no further order need be passed on this writ petition after order was passed by the coordinate bench on 17th February, 2014. 6. Hence, present writ petition is dismissed. 7. However, this order shall not preclude the present petitioner to approach Civil Court in pursuit of remedy. 8.
