And In the matter of : Subash Sarkar @ Subhash Sarkar ……Petitioner. Mr. Arup Kumar Bhowmick .....for the Petitioner. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioner submits that petitioner is innocent and has been foisted with the present criminal case on the basis of the statement of co-accused. Learned advocate appearing for the State has submitted a report and vehemently opposed the prayer for anticipatory bail because of the quantum of 309 grams of brown sugar having been recovered and there are call data records available between the present petitioner and the accused from whom seizure has been effected. Having regard to the nature of complicity, I am of the opinion that this is not a fit case for granting anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioner in CRM (A) 971 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
