1. Affidavit of service filed on behalf of petitioner is taken on record.
2. Learned advocate representing petitioner expresses dissatisfaction with regard to manner of investigation being carried out in investigating Khardah Police Station Case No. 342 of 2026 dated 26th June, 2026. It is submitted that notices are being issued without maintaining requisite time limit.
3. State respondents are represented by learned advocate.
4. If there is grievance relating to steps taken by the concerned police authorities while investigating aforesaid case petitioner needs to approach jurisdictional Magistrate under Section 175(3) BNSS, 2023. In this regard reliance is placed on the judgment of Hon’ble
2 Supreme Court reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and Anr. Vs. State of Maharashtra and Ors.).
5. In paragraph-7 of Sujal Vishwas Attavar (supra) it was decided that even after registration of FIR if investigations are not being carried out appropriately in that event approach has to be made within the statutory framework at the first instance.
6. In view of availability of alternative remedy present writ petition is not entertained and same stands dismissed.
7. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy.
