1. Affidavit of service filed on behalf of petitioner is taken on record.
2. Learned advocate representing petitioner has expressed grievance with regard to manner of investigation being carried out in Regent Park Police Station Case No. 156 of 2026 dated 6th July, 2026. Furthermore, it is submitted by Mr. Chatterjee, learned advocate that accused person is not arrested and there is pressure exerted upon the petitioner to compromise and withdraw the complaint.
3. State respondents are represented by Mr. Rajdeep Majumder, learned Additional Advocate General who has opposed this writ petition and it is submitted that investigation
2 is going on and three accused persons are in judicial custody.
4. In spite of taking steps by the concerned police authorities if petitioner is not satisfied with regard to steps taken while investigating aforesaid criminal prosecution petitioner shall be at liberty to approach jurisdictional Magistrate under Section 175(3) BNSS 2023.
5. In this regard reliance is placed on the judgment of Hon’ble Supreme Court reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and Anr. Vs. State of Maharashtra and Ors.).
6. In view of availability of alternative remedy present writ petition is not entertained and same stands dismissed.
7. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy.
