Learned advocate appearing for the petitioner submits that petitioner is in custody for one year six months and till date charges have not been framed, as such, petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the materials appearing against the present petitioner, prima facie, according to the State there are materials to suggest that the petitioner is having its origin in a neighbouring country. Be that as it may, having considered the period of detention of the present petitioner, as a matter of last chance, I direct the State to complete at least the prosecution witnesses within a period of six months from the next date fixed. If, in spite of cooperation extended by the petitioner the prosecution witnesses cannot be completed, learned trial Court
2 would release the petitioner on bail with a local surety asking for deposit of original deed of the property as a measure of bond. With the aforesaid observations, at this stage, prayer for bail of the petitioner is rejected. However, the learned trial Court would adhere to the observations passed above. Learned advocate appearing for the State will communicate this order to the learned trial Court in seisin of the case. Accordingly, CRM (R) 92 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
