Learned High Court Government Pleader accepts notice on behalf of respondent No.1. 3. The petition is filed to quash the proceedings in C.C. No.656/2026 pending before JMFC, Sira for the offences punishable under Sections 115(2), 126(1), 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023. 4. Learned counsel appearing for the petitioners would submit that, the allegations in the complaint are only omnibus allegations, no specific overtact is mentioned and the charge sheet is filed without there being any material to file the charge sheet for the aforementioned offences. 5. Learned High Court Government Pleader appearing for respondent No.1-State would submit that the charge sheet is filed after collecting the materials. The eye-witnesses have been cited in the charge sheet and the contents of the charge sheet would disclose the cognizable offence. The Court has perused the contents of the complaint as well as the charge sheet and also considered the contentions raised at the Bar and perused the records. 7. In the complaint, it is alleged that the petitioners allegedly stopped the complainant who was riding a tractor and snatched the key of the tractor. It is also alleged that the petitioners have abused the complainant and assaulted the complainant and the villagers came and rescued the complainant. It is also alleged that there is an allegation of life threat by the petitioners to the complainant. 8. Learned counsel for the petitioners would urge that as per the contents of the charge sheet it is stated that the complainant was stopped by the petitioners when complainant was carrying the mud from the property of petitioner No.4- Naresh Gowda. 9. The Court is of the view that the matter requires trial in respect of alleged incident relating to assault and abuse. The proceedings cannot be quashed at this stage. 10.
