Petitioner has made a representation to grant him relaxation in the condition of qualifying service for promotion to a Group-C post; the representation is pending before the competent authority, therefore, petitioner has approached this Court. 4. Mr. Lalit Miglani, learned counsel appearing for Municipal Corporation submits that there are several persons who are eligible for promotion to Group- C post; petitioner has not put in the minimum qualifying service for promotion, therefore, he is apprehensive that his claim will not be considered. He submits that there are certain conditions mentioned in the Relaxation Rules, which have to be adhered to by the employer. He submits that if petitioner meets all the conditions and if sufficient number of persons are not available for promotion, then petitioner’s claim for relaxation shall also be considered. He, however, submits that he has no objection if the writ petition is disposed of by directing the competent authority to take decision on petitioner’s representation. 5. Mr. Sandeep Kothari, learned counsel for the petitioner submits that 2026:UHC:1204 petitioner be permitted to make fresh representation. 6. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh representation to the competent authority, within two weeks from today. If petitioner makes such representation within the stipulated time, the same shall be decided, as per law, within four weeks thereafter.
