[2026:JHHC:1736] -2- ------ 03/ 22.01.2026 Heard learned counsel for the petitioners and learned A.P.P for the State. 2. The petitioners are apprehending their arrest in connection with Margomunda P.S. Case No. 55 of 2025, registered for the offence under Sections 333,127 (2),117(2),126 (2),303(2),132,109(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Madhupur. 3. Learned counsel appearing for the petitioners submits that the petitioners and the informant are agnates and altercation took place due to land dispute and there are case and counter case between the parties and both the sides have received injuries. He next submits that the case filed by the petitioners is numbered as Margomunda P.S. Case No. 62 of 2025. He further submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para- 14 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation of assault is there and even the grievous injury has been received by the informant. 5. Looking into the contents of the FIR, it transpires that there are general and omnibus allegation of assault against all the accused persons and it is not clear that as to on whose blow, the said grievous injury has been received by the informant and it has been pointed out that both the sides are agnates and altercation took place due to land dispute and the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition and further the case diary is also silent on point of the criminal antecedent of the petitioners, I am inclined to grant anticipatory [2026:JHHC:1736] -3- bail to the petitioners. 6. Accordingly, the petitioners, named above, are directed to surrender before the learned court within four weeks from today and in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Madhupur, in connection with Margomunda P.S.
