In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Patuli Police Station Case No.576 of 2025 dated 06.11.2025 under Sections 74/78/79/351(2) B.N.S.2023;
Abhijit Chaudhuri Versus The State of West Bengal
Mr. Jayanta Narayan Chatterjee Mr. Sirsendu Sinha Roy Mr. Santanu Chatterjee Mr. Supreem Naskar Ms. Jayashree Patra Mr. Supravo Day. …for the petitioner.
Mr. Goutam Dey Mr. Suraj Mishra. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner has been foisted with a counterblast criminal case as the petitioner initiated a case under Section 138 of the Negotiable Instruments Act against the husband of the de facto complainant.
State has produced the case diary.
I have taken into account the statement of the victim under Section 183 of the BNSS. Having considered the same, I am of the view that custodial detention of the present petitioner is unwarranted. As such, the prayer for anticipatory bail of the
2 petitioner is allowed.
Accordingly, in the event of arrest, the petitioner, namely, Abhijit Chaudhuri shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date.
Accordingly, CRM(A) 2939 of 2026 is allowed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
