Accused in S.C.No.1054 of 2026 pending before the Court of XLV Additional City Civil & Sessions Judge, Bengaluru registered in Crime No.177 of 2026 by Bellanduru Police Station, Bengaluru City for offence punishable under Section 109(1) of BNS, 2023 is before this Court in this petition filed under 483 of BNS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.177 of 2026 was registered by Bellanduru Police Station, Bengaluru City for the aforesaid offence against petitioner herein, based on the first information dated 16.04.2026, received from Sri Mohammed Afaque Hussain son of the injured victim. In the said case, petitioner was arrested on 16.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.7836 of 2026 was rejected on 13.08.2026. Material on record would go to show that the petitioner is the husband of the injured victim and father of the first informant. It is alleged that since the wife and children of petitioner were not listening to him, he allegedly had a vengeance against them and it is in this background, he allegedly assaulted his wife on 16.04.2026 causing injuries to her. Wound certificate of the injured victim, would go to show that she had suffered three injuries as a result of assault made by the petitioner with a knife. Injury nos.2 and 3 are said to be simple injuries and injury no.1 is a cut injury on the right hand of the injured victim which is certified as a grievous injury by the medical officer. The said injury is not caused on the vital part of the body. The petitioner, aged 69 years, has no other criminal antecedents. He is in custody for the last four months. Investigation of the case is already completed. Accordingly, the following: ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.1054 of 2026 pending before the Court of - 4 - HC-KAR CNR: KAHC010572612026 NC: 2026:KHC:49585 CRL.P No. 12635 of 2026 XLV Additional City Civil & Sessions Judge, Bengaluru registered in Crime No.177 of 2026 by Bellanduru Police Station, Bengaluru City for offence punishable under Section 109(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. - 5 - HC-KAR CNR: KAHC010572612026 NC: 2026:KHC:49585 CRL.P No. 12635 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
