Learned advocate for the petitioner submits that the petitioner has been falsely implicated in the instant case after showing recovery of 2.456 kg of codeine mixture. According to the petitioner, charge-sheet has already been submitted before the learned jurisdictional court and the petitioner is in custody for more than six months. State has opposed the prayer for bail as commercial quantity of contraband has been seized. Having considered the quantum of contraband, I am of the opinion that the rigors of Section 37 of the NDPS are attracted, as such, I am not inclined to grant bail to the present petitioner.
2 Hence, the prayer for bail of the petitioner is Rejected. However, the petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. The learned trial court after consideration of charges will fix the evidence of the independent witnesses and the same be completed preferably within three months from date of framing of charges. Accordingly, CRM (NDPS) 1933 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
