JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners filed this review petition to review the judgment dated 25.03.2025 passed in RSA No.1273 of 2016. 2. Brief facts leading rise to filing of this review petition are as follows: - 3 - HC-KAR CNR: KAHC010379612026 NC: 2026:KHC:47713 RP No. 315 of 2026 It is the case of the petitioners that the respondent, with a mala fide intention to grab the valuable property worth about more than Rs.50,00,000/- as on the date of agreement, taking advantage of the illiteracy and ignorance of the petitioners has made the terms of the mortgage as agreement of sale and has cheated on the petitioners. The transaction between the petitioners and the respondent is a loan transaction and not a sale transaction. It is contended that the respondent is in the habit of cheating and number of criminal cases are registered against the respondent in C.C.No.1660/2022. It is also contended that the petitioners have lodged the complaint before the local police. Hence, he prays to review the judgment. 3. Heard the learned counsel for the petitioners. 4. Learned counsel for the petitioners submits that the respondent is the money lender and is the habitual offender and number of criminal cases are pending against - 4 - HC-KAR CNR: KAHC010379612026 NC: 2026:KHC:47713 RP No. 315 of 2026 him. Thus, the respondent has played fraud on the petitioners. Thus, there is an error apparent on the face of the record. Hence, on these grounds, he prays to allow the review petition. 5. Perused the records and considered the submissions of the learned counsel for the petitioners. 6. The petitioners have not taken any defence in the written statement insofar as regarding the criminal cases are lodged against the respondent. The said criminal case was registered against the respondent in 2022 and the petitioners have not produced any records to show that the criminal cases are pending against the respondent. Further, learned counsel for the petitioner was unable to point out the error apparent on the face of the record in the impugned judgment. 7. I have perused the entire impugned judgment.
