1. We have heard the learned counsel appearing for the respective parties.
2. Learned Junior Standing Counsel for the Respondent-State has placed on record a copy of the notification dated 12th August, 2026, issued by the Sub- Divisional Officer (Sadar), Malda, indicating that the ARTO, Malda HQ, is co-ordinating with the SDO for formation of an inspection team so as to ensure inspection of identified stretches occupied by hawkers.
3. Considering the above, we do not find that there is any cause of action prompting the Petitioners to file this Petition.
4. Learned advocate for the Petitioners submits that in the event a fresh cause of action arises, the Petitioners would avail of a remedy as is permissible in law.
