10/09 2026 AD/40/18 266312 NANDY (DISMISSED) In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side WPA/25835/2024 LAXMI GHOSE & ORS. VS THE STATE OF WEST BENGAL & ORS. Mr. Younush Mondal, Advocate ……for the Petitioner Mr. Pulakesh Bajpayee Advocate Mr. Subit Majumdar, Advocate ……for the State 1. The petitioners are aggrieved that in spite of being on the panel for promotion for the Anganwadi Helpers to the post of Anganwadi Workers, the petitioners were not given such promotion. 2. This panel was made only for the purpose of any vacancy arising due to resignation, death, or any other reason. These empanelled persons would not be considered to fill up any other promotional vacancy created after the notification of 05.10.2023. 3. The tenure of this panel was till 03.01.2026. 4. Thus, if any other vacancy arose, the same would not be available for these empanelled candidates. 5. The panel has now expired. Unfortunately, the petitioners have not participated in the regular promotional process undertaken on 03.08.2024. 6. Since the panel has already expired on 03.01.2026, the petitioners cannot be considered for promotion from that panel. 7. In any event, promotion is restricted, in so far as that panel is concerned, to posts arising out of resignation, death, or any other reason. P a g e | 2 8. In view of the afore-stated, the writ petition has presently become infructuous and the reliefs prayed for cannot be considered. 9. The writ-petition is accordingly dismissed. There shall be no order as to costs. (Reetobroto Kumar Mitra, J.)
