JUSTICE H.P.SANDESH ORAL ORDER This matter is listed for admission. Heard the learned counsel appearing for the respective parties. 2. This petition is filed praying this Court to quash the proceedings initiated by the Trial Court against the petitioners herein based on the private complaint exercising the powers under Section 156(3) of Cr.P.C. 3. On perusal of the records, it discloses that the Trial Court perused the complaint averments and also the documents produced before the Trial Court and passed the pre-cognizance order referring the matter under Section 156(3) of Cr.P.C. But the fact is that mere registration of the case itself is not enough and the Investigating Officer has to investigate the matter having considered the allegations made in the complaint and submit the report when specific allegations are made for the offences of creation of fake documents and sham documents in order - 5 - HC-KAR CNR: KAHC010181412019 NC: 2026:KHC:49394 CRL.P No. 4475 of 2019 to reject the claim. The private complaint is filed in this regard. 4. The counsel appearing for the petitioners would submit that, now the claim is settled. But, here is not the question of settlement of the claim of respondent No.2/complainant, only Investigating Officer has to examine in view of the contents of the complaint that whether fake documents are created and sham documents are also relied upon or not in refusing the claim of the complainant. The same needs to be investigated by the Investigating Officer. Hence, the question of entertaining this petition does not arise since the order passed by the Trial Court is only a pre-cognizance order and cognizance is not yet taken. Only after submitting the final report, the Trial Court has to examine the charge sheet material for taking cognizance. Thus, question of entertaining the petition under Section 482 of Cr.P.C does not arise and no grounds are made out to entertain the petition under - 6 - HC-KAR CNR: KAHC010181412019 NC: 2026:KHC:49394 CRL.P No. 4475 of 2019 Section 482 of Cr.P.C in view of only pre-cognizance order has been passed by the Trial Court. 5. In view of the discussions made above, I pass the following: ORDER The petition is dismissed.
