Learned Additional Government Advocate accepts notice for respondents No.1 to 3.
2. In this petition, the petitioners are assailing the
order dated 03.04.2025 passed by the Deputy Commissioner, (Annexure- N), the order dated 07.02.2025 passed by the Special Assistant Commissioner (Annexure- Q) and order dated 11.12.2015 passed by the Assistant Commissioner (Annexure-R), inter alia seeking direction to the Tahsildar, Ramanagara Taluk to enter the name of the

petitioners by way of inheritance in respect of the land in question.
3. It is submitted by the
learned counsel appearing for the petitioners that, by referring to the findings recorded by the respondent-authorities and also the order passed by this court at Annexure-T, wherein this court has reserved liberty to the petitioners to approach the Karnataka Appellate Tribunal.
4. Accordingly it is submitted by the learned counsel for the petitioners that the petitioners have approached the Karnataka Appellate Tribunal. However, immediately, thereafter, the khata has been changed pursuant to the order passed by respondent No.2 herein. It is therefore, submitted that the impugned orders require interference in this writ petition as the petitioners were in possession of the land in question.

5. Per contra, learned Additional Government Advocate also sought to justify the impugned orders and submitted that the petitioners herein have suffered the judgments and decrees in O.S.No.161/2004, and in RA No. 37/2010. Thereafter RSA No.2065/2017 is pending
consideration before this court and the petitioners have to establish their rights over the property. Accordingly, he sought for dismissal of the petition.

In the light of the submissions made by the counsel appearing for the parties, on careful consideration of the same would indicate that the subject land which the petitioners are claiming is the subject matter in O.S.No. 161/2004 which was filed by the petitioners seeking declaratory relief against respondent No.4 herein, was dismissed and thereafter, R.A.No.37/2010 and R.A.No. 39/2010 have been filed before the First Appellate Court which came to be dismissed. Thereafter RSA No. 2065/2017 is pending consideration before this court.

7. In that view of the matter, I am of the view that since the petitioners have to establish their right over the land in question, no interference is called for regarding the findings recorded by the respondent-authorities. However, it is open for the petitioners herein to approach the competent authority after the conclusion of the proceedings in the Regular Second Appeal. Accordingly, the writ petition is dismissed.

disposed of accordingly.
