Having considered the submissions made on behalf of the petitioner and the opposite party, the prayer for restoration is allowed. Let the application being CRR 183 of 2026 be restored in its original file with original number after setting aside the order of dismissal dated 8.4.2026. CRAN 1 of 2026 is accordingly disposed of. Re: CRR 183 of 2026 Affidavit of service and supplementary affidavit filed by the petitioner are taken on record. It is submitted by learned counsel for the opposite party that the opposite party has challenged the self-same impugned order dated 8.12.2025 before the learned Additional Sessions Judge, 2 being Criminal Motion no. 5 of 2026 and which has been fixed for hearing on 11th September, 2026. Therefore, learned counsel for the opposite party submits that let the present application be allowed to be withdrawn by the petitioner so that, the self-same issue can be heard and disposed of by the concerned revisional court and in that event, the parties also will not lose a forum. Having considered the submissions made on behalf of the petitioner and the opposite party, let the application being CRR 183 of 2026 stand dismissed as being withdrawn. The revisional court shall make every endeavour for expeditious disposal of the said application being Criminal Motion no. 5 of 2026 and to conclude the hearing preferably within a period of three months from the next date of hearing. However, this dismissal order will not prevent the petitioner in future to prefer a similar application, if he is so instructed, after determination by the revisional court.
