The petitioner is apprehending his arrest in connection with Mohanpur P.S. Case No. 185 of 2024, registered for the offences under Section 308(4), 109 & 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act, pending in the Court of Learned Sub-Divisional Judicial Magistrate, Deoghar. 3. Learned counsel appearing for the petitioner submits that the petitioner is innocent and the name of the petitioner has come in the confessional statement and even the petitioner is not named in the FIR. On this ground, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that by the last order, the case diary was called for and further in Para 66 of the case diary, it has come that Sachin Ray, who has fired upon the Bablu Thakur, has stated that the said pistol was taken from this petitioner and thereafter he has fired. 5. Considering that the pistol was taken from this petitioner by 2026:JHHC:7735 2 Sachin Ray and from that pistol Sachin Ray has shot upon Bablu Thakur. In that view of the matter, I am not inclined to grant anticipatory bail to the petitioner. 6. Accordingly, prayer for anticipatory bail is hereby rejected.
