ORAL JUDGMENT

The present Writ Appeal has been filed under Section 19(1) of the Family Court Act by the appellant/husband, impugning the judgment and decree dated 31.01.2023 passed by the Senior Civil Judge and JMFC, Soraba, in Misc.C.No.37/2019 instituted by the appellant/husband seeking a decree of divorce on the ground of cruelty as defined under Section 13(1)(ia) of the Hindu Marriage Act,
1955.
2. The marriage between the appellant and respondent was solemnised on 15.12.2013. There is no issue out of the wedlock. During the pendency of this appeal, the parties have settled their disputes before the Mediation Center and they have filed joint application under Section 13-B of the Hindu Marriage Act supported

by two affidavits. Parties are present before this Court. They have stated that they stand by the contents of the application filed under Section 13-B of Hindu Marriage Act. The respondent/wife has accepted Rs.17,00,000/- on 25.04.2025 as permanent alimony and towards settlement of all her claims, rights and entitlement. She is present in the Court and submitted that all her claims, entitlements towards alimony and maintenance are now settled and nothing is due and payable by the appellant. She will not have any rights in respect of any moveable or immovable property or assets existing or to be acquired in future by the appellant.
3. Considering the aforesaid facts and in the light of the joint application filed under Section 13-B of the Hindu Marriage Act, we pass a consent decree dissolving the marriage between the appellant and respondent solemnised on 15.12.2013.

The appeal is allowed. The impugned judgment and decree passed in M.C.No.37/2019 dated 31.01.2023 by the Senior Civil Judge and JMFC, Soraba is set aside.
Let a consent decree be drawn accordingly.
