Bandyopadhyay … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than eight months and has been implicated on the foundation of alleged recovery of 345 gm of heroin. Learned advocate for the State opposes the prayer for bail as commercial quantity has been recovered. I have taken into account the chemical examiner’s report which reflects the presence of diacetylmorphine and monoacetylmorphine and other narcotic substances which have not been quantified. Having considered the same, I am of the opinion that the petitioner is guided by the proposition as laid down in 2 [Sentu Seikh v. State of West Bengal [SLP (Crl.) No. 13987 of 2025]. Taking into account the same, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Jiarul Sk. shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), Nadia, Krishnagar. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Nadia without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1922 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence and the report submitted by the State be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
