1. Affidavit-of-service and supplementary affidavit filed on behalf of petitioner are taken on record. 2. Matter is heard in presence of the learned advocates representing petitioner and State respondents. 3. Mr. Malay Bhattacharya, learned advocate representing petitioner has submitted that an application was made to Superintendent of Police, Purba Bardhaman on 31st August, 2026 seeking permission to convene a meeting at Shyamsundar Bazar on 11th September, 2026 in between 3:00 PM to 6:00 PM. 4. It is submitted on behalf of petitioner that after filing this writ petition on 8th September, 2026, vide e-mail letter dated 8th September, 2026 Officer-in-Charge, Raina

Bardhaman communicated to petitioner the decision of the police authority not to give permission to convene said meeting on 11th September, 2026 at Shyamsundar Bazar. Copy of said e-mail letter dated 8th September, 2026 of concerned police authority is annexed at page 5 of the supplementary affidavit. [2]

On perusal of said e-mail letter dated 8th September, 2026 it transpires that proposed place, that is, Shyamsundar Bazar where petitioner decided to hold meeting is a three point crossing from where roads are leading to Jamalpur, Arambagh and Bardhaman main road. According to police authority, holding meeting at Shyamsundar Bazar may create inconvenience so far local residents are concerned and it will also lead to traffic congestion since meeting is scheduled to be organized on a working day that too in between 3:00 PM to 6:00 PM. 6. Mr. Billwadal Bhattacharyya, learned Additional Advocate General has submitted on instruction that Shyamsundar Hattola may be considered as an alternative place for holding said meeting at a particular time with lesser number of participants. 7.
Having considered the submissions made on behalf of State respondents and taking note of the case made out in this writ petition, petitioner shall be permitted to hold meeting on 11th September, 2026 at Shyamsundar Hattola subject to following conditions as enumerated below: i) Meeting shall be organized in between 4:00 PM and 6:00 PM; ii) Number of participants shall be not more than eight hundred (800); iii) During the meeting no inflammatory speech shall be made which may lead to communal tension; iv) Petitioner shall share particulars and mobile numbers of five volunteers, who will be
[3] responsible for complying directions of this Court during meeting, by 8 PM today with Officer-in-Charge, Raina Police Station, Purba Bardhaman; v) Concerned police authority is directed to depute adequate number of police personnel to maintain law and order and to see that no untoward incident takes place; vi) After the time fixed by this Court for holding such meeting crowd shall be dispersed immediately thereafter. 8. With aforesaid directions writ petition stands
disposed of.
9. Learned advocates representing petitioner and State respondents are directed to communicate gist of this
order immediately to the Officer-in-Charge, Raina Police Station, Purba Bardhaman without waiting for server copy of the order.
