This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.10/2026 registered at Police Station Gidhouri (Police Chowki Giroudhpuri(, District Balodabazar-Bhatapara (CG) for the offences under Sections 137(2), 87, 64(1), 3(5) of B.N.S., and Section 6 of the POCSO Act, 2012 and Section 3(2)(v) of the SC & ST (PoA) Act, 1989. 2. As per the prosecution case, the applicant is accused of assisting the main accused Budheshwar in alluring and kidnapping the victim, who is below 18 years of age and a member of Scheduled Caste, thereby offence has been committed.

Learned counsel for the applicant submits that he has only accompanied main accused Buddeshwar and victim and left them at Bus- stand and the applicant has not committed any offence, therefore, the involvement of the applicant has been limited to that extent. He submits that there are total 23 witnesses; trial has not yet commenced, the applicant is in jail since 09.02.2026 and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim was minor.
5. The victim along with her father has appeared through VC from the concerned DLSA and raised objection to grant bail.
6. Having considered the submissions made by learned counsel for the parties and further looking to the nature of allegation made against the applicant as also the fact that the trial is likely to take time, I am inclined to release the applicant on regular bail.
7. Accordingly, this bail application is allowed and the applicant is
directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed in that behalf. Cc as per rules. Sd/-
