ORAL ORDER
1. Accused No.2 in Crime No.147/2026 registered by Arakalagud Police Station, Hassan, for the offences punishable under Sections 109, 115(2), 118(1), 126(2), 351(2), 351(3), 352 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.147/2026 was registered by Arakalagud Police Station, Hassan, for the aforesaid offences against one Pradeepa and petitioner herein based on the first information dated 15.07.2026 received from Vasantha P B, who is the injured victim in the present case. During the course of investigation, petitioner was arrested on 16.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.777/2026 was rejected on 29.07.2026. Therefore, he is before this Court. - 3 -

4. Material on record would go to show that accused No.1 - Pradeepa and the first informant had prior enmity and they had quarreled against each other even earlier to the incident in question. In the incident in question that had taken place on 15.07.2026, the allegation of assaulting injured victim with iron rod is found against accused No.1, who is also arrested and remanded to judicial custody in the present case. Learned HCGP has submitted that injured victim has suffered one injury on his face, which is a nasal bone fracture and the said injury is said to be a grievous injury. Injuries caused on the face of the injured victim corroborates to the assault made by accused No.1 with iron rod. It is brought to the notice of this Court that petitioner has no other criminal antecedents. Under the circumstances, the following order:-
5. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.147/2026 registered by Arakalagud Police Station, Hassan, for the offences punishable under Sections 109, 115(2), 118(1), 126(2), 351(2), 351(3), 352 read with Section 3(5) of BNS, 2023, subject to the following conditions:

a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
