ORAL ORDER
1. Sri. Vinay Venugopal, learned Central Government Senior Counsel accepts notice for respondent no.1.
2. Sri. Francis Xavier, learned counsel accepts notice for respondent no.4.
3. Notice to respondent nos.2 and 3 is dispensed with in view of the proposed order to be passed.
4. Petitioner is before this Court seeking for the following reliefs. a. Issue a writ of certiorari quashing the communication dt: 28/07/2026 served on 03/08/2026 threatening to transfer the sum of Rs.55,126/- (Rupees Fifty Five Thousand One hundred and Twenty Six only), Rs. 3527/- (Rupees Three Thousand Five Hundred and Twenty Seven only) and Rs. 135261/- (Rupees One Lakh Thirty Five Thousand Two hundred and Sixty One only)as per ANNEXURE-B b. Issue a writ of mandamus directing the respondents 1, 2 & 4 to recover the money involved in Cyber crime from the 3rd respondent without causing losses to the petitioners. c. Issue any other writ or direction or any relief that this Hon'ble Court deems fit to grant in the facts and circumstances of the case including the /order as to costs;
5. A perusal of the papers indicates that the communication dated 28.07.2026 has been issued in pursuance of the order dated 22.07.2026 in the

Court of P.Bardoloi, SDJM(S)-II, Cyber PS GDE No.020 dated 18.05.2026.
6. When the Magistrate has passed an order directing the concerned banks to initiate the refund process of the amount of the victim who was a complainant in those proceedings, it is but required for the respondents to act on the said directions, which have been so issued, since in cybercrime matters the cause of the victim is required to get precedence. If at all the petitioner is aggrieved by any of the directions passed by the learned Magistrate, it would be for the petitioner to avail of necessary remedies in relation thereto.
7. This Court, not having any jurisdiction over the P.Bardoloi, SDJM(S)-II, Cyber PS GDE No.020, the above petition is not maintainable before this Court.
8. Reserving such liberty, petition stands dismissed.
