JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking his enlargement on bail for it having been turned down by the concerned court in Special Case No. 286 of 2025, registered for offences punishable under Section 65(1) of the BNS, 2023 and Sections 4 and 6 of Protection of Children from Sexual Offences Act, 2012 (the POCSO Act' for short). 2. Heard Sri. S. Shehinsha Ali, learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1 and have perused the material on record. 3. The complainant, one Smt. Sharadamma registers a complaint before the jurisdictional police. The allegation is that the petitioner, driver of a JCB has committed the act of brutal sexual assault upon a girl aged about 14 years and therefore, the crime comes to be registered. The concerned Court, by its order dated 19.05.2025, rejected the bail. The police, after investigation, file a charge sheet and the petitioner after filing - 4 - HC-KAR NC: 2026:KHC:22063 CRL.P No. 7807 of 2025 of the charge sheet has taken a second chance for seeking granting of bail on the score that the charge sheet is filed and the proceedings are pending in Special Case No.286 of 2025. The allegation against the petitioner is horrendous. 4. In the light of the said allegation, whether the fact of filing of the charge sheet or not filing of the charge sheet would not make any difference atleast for now for the reason that the petitioner being a driver of a JCB sees an innocent girl of 14 years old, half of his age and commits the act of rape. Therefore, there is no warrant of grant of bail to the petitioner at this juncture. 5. Reserving liberty to the petitioner to knock at the doors of the appropriate fora in the event of any changed circumstance, the petition stands rejected.
