1. Matter is taken up for consideration in terms of order dated 19th August, 2026 when respondent no. 7 is represented by learned advocate who has submitted that ex parte decree dated 27th March, 2023 obtained by petitioner in Title Suit No. 1262 of 2015 is confined to land under LR Dag No. 779 appertaining to Mouza Muragacha JL No. 30 under Police Station Khardah. It is also submitted on behalf of respondent no. 7 that respondent no. 7 has not claimed any right with regard to land under said LR Dag No.

779. In the same breath it is also submitted that respondent no. 7 has right over land under Dag No. 779/984 under RS Khatian No. 370 Mouza Muragacha JL No. 30.
2. In support of such contention copy of record of rights is placed before this Court and same is taken on record.
3. On perusal of decree dated 27th March, 2023 it appears suit land is confined to LR Dag No. 779 and it does not cover land under Dag No. 779/984. Therefore, petitioner shall be at liberty to take steps by virtue of decree dated 27th March, 2023 in accordance with law but such steps shall not go beyond ambit of LR Dag No. 779.
4. With the aforesaid clarification writ petition is disposed of.
