By presenting this writ petition prayer is made for directing concerned police authorities to arrest accused person in Berhampore Police Station Case No. 610 of 2026 dated 26th April, 2026. Prayer is also made to direct the police authorities to disclose progress made in the investigation. 2. Learned advocate representing petitioner submits that pre-arrest bail applications were moved by three accused persons and both the applications were rejected. Copy of the orders passed by the coordinate bench dated 31st July, 2026 on applications seeking pre- arrest bail are placed before this Court and same are taken on record. 3. Mr. Das, learned Additional Government Pleader representing State respondents has 2 filed a communication dated 8th September, 2026 of Inspector-in-Charge, Berhampore Police Station and same is taken on record. Copy of said communication is made over to learned advocate representing petitioner. 4. It is disclosed in the said communication dated 8th September, 2026 steps which have been taken while investigating Berhampore Police Station Case No. 610 of 2026 dated 26th April, 2026. 5. If petitioner is dissatisfied with manner of investigation being carried out in connection with aforesaid criminal prosecution in that event petitioner shall be at liberty to approach jurisdictional Magistrate under Section 175(3) BNSS 2023. In this regard reliance is placed on the judgment of Hon’ble Supreme Court reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and Anr. Vs. State of Maharashtra and Ors.). 6.
