ORAL ORDER
(PER: HON'BLE MR. JUSTICE JAYANT BANERJI)
When the matter was listed yesterday, the following
order was passed:
“A compliance affidavit has been filed today by the learned AGA, which is taken on record. Paragraph Nos.3, 4, 5 and 6 are quoted below:
“3. I state that in pursuance to order made in Writ Petition No.7808 of 2022, directions were given to Principal, Government Law College, Kolar to make difference payment for the period from 27.10.2010 to 23.08.2011, when the Complainant was kept under suspension, and accordingly, difference pay for said period was calculated at Rs.261670/- and same has been credited to the Complainant on 17.03.2025 to the account of the Complainant. The Copy of document for having made payment is produced herewith as Annexure-R1.
4. Further, I state that with regard to payment of interest on delayed period of release of pensionary benefits from the period of 30.05.2015 till 11.03.2020, it is submitted that the Complainant was sanctioned provisional pension upon superannuation and said provisional pension is nothing but full entitled pension and as such, it is submitted that no interest was payable upon pension amount. But, with regard to pensionary benefits, it is submitted that

DCRG amount paid to Complainant was Rs. 813818/- and interest as per order made in Writ Petition No.7808 of 2022 was to be paid to the Complainant. Accordingly, the Respondents calculated the interest amount upon DCRG which came to Rs.295650/- and a proposal was sent to Government for concurrence to pay interest amount to the Complainant and after examining the proposal, the Higher Education Department has issued order dated: 07.01.2026 and corrigendum dated: 03.03.2026 with the concurrence of Finance Department sanctioning the payment of interest amount of Rs. 295650/- to the Complainant and same was credited to the account of Complainant on 09.03.2026. The Copy Government
Order dated: 07.01.2026, Corrigendum dated: 03.03.2026 and that of document for having made payment on 09.03.2026 is produced herewith and marked as Annexure-R2 to R4.
5. I state that with regard to payment of interest upon pay difference for the suspension period from 27.10.2010 to 23.08.2011, which was calculated and paid to the Complainant amounting to Rs.261670/-, it is submitted that a proposal was sent to the Government for the permission to pay interest amount of Rs.303503/- for difference of pay paid to the Complainant and the Government has authorized payment of said amount and accordingly, interest amount of Rs.303503/- towards interest on upon pay difference for the suspension period from 27.10.2010

to 23.08.2011 has been paid on 04.09.2026. The copy of transaction details of Treasury for having paid Rs.303503/- is produced herewith and marked as Annexure-R5.
6. I state that in terms of order dated 09.12.2024 in W.P. No. 7808/2022, the Respondents have paid pay difference of Rs.261670/- on 17.03.2025 and Rs. 295650/- towards interest on delayed payment of pensionary benefits on 09.03.2026 and interest amount of Rs.303503/- towards pay difference. Hence, it is submitted that directions given in order dated: 09.12.2024 in W.P. No. 7808/2022 has been complied.”
However, we find that no apology has been tendered. As prayed by the learned AGA, put up this matter on 09.09.2026 to enable her to obtain instructions.”
2. Today, a compliance affidavit has been filed by the learned AGA, which is taken on record.
3. At paragraph No.4 of the compliance affidavit, an unconditional apology is tendered for the delay in complying with the order of this Court.

4. It is noted and as stated by the learned counsel for the complainant, the order of the writ court is complied with. This contempt case is accordingly consigned. `
