This is an application for condonation of delay of 2900 days in filing revision application. Mr. Malnas, the
learned counsel for the applicant submits that the present revision is filed challenging the judgment and order dated 24.02.2017 passed by the learned Judicial Magistrate First Class, Court No.2, Amravati in Summary Criminal Case No.994 of 2010, whereby the applicant was convicted and sentenced to suffer simple imprisonment for six months and compensation amount of Rs.4,08,975/-. The cheque amount was only Rs.2,85,000/-. However, the entire compensation amount is now paid by the applicant through the cheque which is deposited before the registry as directed by this Court vide order dated 13.07.2026. 2026:BHC-NAG:10921

3. Mr. Malnas, the learned counsel for the applicant further submits that the applicant was facing financial crunch and was therefore unable to file the revision application within limitation. The applicant could not arrange the money to challenge the judgment and order passed by the learned trial Court directing the applicant to deposit the compensation amount. The applicant has now paid the entire amount of compensation as directed by this Court. The delay may therefore be condoned. 4. As against this, Mr. Badhe, learned counsel for the non-applicant No.1 strongly opposes the application for condonation of delay on the ground that the applicant has failed to show sufficient cause for not approaching this Court challenging his conviction. The applicant has now preferred the present revision application after a delay of about 2900 days. It is almost settled law that the delay of each and every day has to be explained in detail. There is no sufficient cause shown and the delay appears to be inordinate. Mr. Badhe further submits that merely because the applicant is depositing the amount of compensation would not be a sufficient ground to condone the delay, as the delay is inordinate. Hence, the application is liable to be rejected. 5. I have gone through the reasons stated in the application. The judgment dated 24.02.2017 directs the applicant to pay the compensation amount of Rs.4,08,975/-. The cheque amount against which the complaint was filed under Section 138 of the NI Act is only
3 26.APPR.166.2026.odt to the tune of Rs.2,85,000/-. The applicant has stated in the application that he was facing financial crunch. The applicant is an agriculturist and labourer and has to go to different places several times for his livelihood. He was, therefore, unable to contact his counsel. The appeal filed against the conviction of judgment also came to be dismissed.
The counsel for the applicant did not inform the dismissal of the appeal. Hence, the delay has occurred in preferring the present Revision Application. 6. Be that as it may, since the applicant/accused has paid the entire amount of compensation as directed by the learned trial Court vide judgment dated 24.02.2017 passed in Summary Criminal Case No.994 of 2010, I am inclined to condone the delay under Section 5 of the Limitation Act. Hence, I pass the following order :-
ORDER a) The delay of 2900 days in filing revision application is hereby condoned. b) The Revision Application shall be registered. c) Application for condonation of delay is hereby
disposed of.
