THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 6 - HC-KAR CNR: KAHC010102482026 NC: 2026:KHC:49725-DB RP No. 60 of 2026 CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The review petitioners have filed the present review petition seeking review of the order dated 17.03.2025 passed by the Co- ordinate Bench of this Court in W.P.No.19463/2021 (GM-RES-PIL). 2. The present review petition has been filed after an inordinate delay of 298 days. The learned counsel appearing for the review petitioners submits that the delay is essentially on account of the review petitioners preferring a Special Leave Petition [SLP (Civil) Diary No.62005/2025] before the Hon'ble Supreme Court. He also submits that the review petition has been filed pursuant to the order dated 24.11.2025 passed by the Supreme Court in the said SLP. The order dated 24.11.2025 passed by the Supreme Court reads as under: "The learned Senior counsel appearing for the petitioners submitted that the High Court has recorded incorrect facts in the impugned order. If that is the case, it is well open to the petitioners to file a Review Petition before the High Court. - 7 - HC-KAR CNR: KAHC010102482026 NC: 2026:KHC:49725-DB RP No. 60 of 2026 In the event the Review Petition is dismissed, liberty is given to the petitioners to challenge the same before this Court. The Special Leave Petition stands disposed of in the above terms. 3. It is apparent from the above that the observations of the Supreme Court to the effect that, it was open for the review petitioners to file a review petition before this Court was premised on the submission that this Court had recorded incorrect facts in the order dated 17.03.2025. 4. The relevant facts on the basis of which the writ petition was dismissed are recorded in paragraph 5 of the order dated 17.03.2025, the review of which is sought. 5. On a pointed query from this Court as to which is the fact that is recorded, to which the review petitioners take an exception, the learned counsel appearing for the review petitioners submits that there is no error in the facts as recorded in the impugned order. He submits that, there was another report which was not considered. - 8 - HC-KAR CNR: KAHC010102482026 NC: 2026:KHC:49725-DB RP No. 60 of 2026 6. Plain reading of the order dated 17.03.2025 indicates that the conclusion rests on the basis of facts as set out therein. In view the above, we find no grounds to review the said order. 7. The review petition is, accordingly, dismissed. Sd/- (VIBHU BAKHRU) CHIEF JUSTICE Sd/- (M.I.ARUN) JUDGE KMV List No.: 19 Sl No.: 2
