GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION No.21662 OF 2020 ORDER : 1. The learned counsel appearing for the petitioner submits that the petitioner executed the works entrusted by respondent No. 3 and raised the corresponding bills for the works executed. It is submitted that the petitioner entered into an agreement with respondent No.3 on 11.09.2012 and, after supplying the material in accordance with the terms of the tender notification and the agreement, became entitled to payment of the bills. It is further submitted that several representations were made to respondent No. 3 requesting release of the amounts due under the said bills. 2. The learned counsel for the petitioner submits that the representations dated 11.09.2014, 02.05.2016, 01.01.2017, 09.02.2018, 13.12.2018, 30.01.2019 and 03.05.2019 were received by respondent No. 3. However, no orders have been passed on the said representations till date. 3. The learned Standing Counsel appearing for respondent No. 3 seeks time to obtain the latest instructions in the matter. 4. Having regard to the fact that the writ petition is filed in the year 2020 and relates to non-payment of bills arising out of works executed in the year 2012, this Court is of the view that the ends of justice would be met by directing respondent No. 3 to consider and dispose of the petitioner's pending representations in accordance with law. The petitioner shall to submit a fresh representation, enclosing copies of the earlier representations and bringing the same to the notice of respondent No.3. Upon receipt of such representation, respondent No. 3 shall consider the same and pass appropriate orders, in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 5. Accordingly, the writ petition is disposed off. There shall be no order as to costs.
